Official Terms and Conditions for Participation at Winpoker
This WinPoker End User License Agreement (“Agreement”) constitutes a legally binding agreement between (a) you, the end user (“you, your, yours”) and (b) WinPoker.com (“WinPoker”). It is essential that you read and understand these terms and conditions. PLEASE READ AND PRINT THIS AGREEMENT IN ITS ENTIRETY BEFORE ACCEPTING THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS YOU MUST DELETE THE WINPOKER SOFTWARE FROM YOUR COMPUTER(S) AND ABSTAIN FROM USING ANY SERVICES IN CONNECTION WITH THE SITE.
General rules
Participation in the online casino games (collectively the "Games") are open to residents of legal age in a jurisdiction of residence, where the Games are not prohibited. Employees of Winpoker (the "Company"), its licensees, distributors, wholesalers, affiliates, and subsidiaries are not eligible to participate in the Games. A person who participates in the Games is hereafter called "Player" or "User".
By accessing this site, opening an account, using and reusing of such an account, participation in the Games, or accepting any prize, Player represents, warrants and certifies that he fully understands and agrees to comply with the following terms and conditions (including any revisions which may periodically take place). Player also agrees to comply with our "Promotions Terms and conditions" and "Privacy Policy" that are incorporated by reference into these terms and conditions. Failure to abide by these terms and conditions may result in disqualification, account closure, forfeiture and/or legal action.
1. Terms and conditions have been prepared in various languages other than English for reference only. In the event of any difference between the English version of the Terms and Conditions (accessible from the homepage) and this version, the English version shall prevail.
2. The management reserves the right to make changes in the rules at any time. At least once a month, Player agrees to review the terms and conditions on the web site: www.winpoker.com.
3. Winpoker Limited markets various games through its website winpoker.com. Winpoker is subject to the laws and regulations of Malta.
4. Player fully understands the standards and laws, as such standards and laws relate to the Games, of the community/legal jurisdiction where he/she is resident. Player has the complete and unrestricted legal right to participate in the Games. Player's participation in the Games is not prohibited by any government with proper jurisdiction.
5. Player has reached the age of 18 or the legal age of majority in his/her jurisdiction, whichever is greater.
6. Player shall not allow any other person or third party; including, without limitation, any minor, to use or reuse Player's account, accept any prize, or participate in the Games.
7. Any applicable taxes and fees in connection with any awarded prize are the sole responsibility of Player. Prizes cannot be transferred, substituted, or redeemed for any other prize.
8. Participation in the Games is personal and not professional.
9. Each Player is only allowed to have one account with Winpoker. Opening of multiple accounts is not permitted. Should we have reasonable suspicions that any of our customers has opened multiple accounts with us we reserve the right in our absolute discretion to freeze that customer’s account or to close the account immediately and the customer shall forfeit all his winnings. Customers should also note that their original deposits will not be refunded. Customers shall also be liable towards Winpoker for damages and costs incurred as a result of the fraud.
We specifically do not permit our customers to do any of the following:
* To act on behalf of another person or third party;
* To deposit money originating from criminal activity;
* To deposit money through a credit card which a customer is not authorized to use, or knowingly receiving money from such card on in any other manner colluding with a third party to so do;
* To use in any manner whatsoever their player account or that of third parties for money laundering or any other illegal purpose.
We strictly prohibit the use of robotic, mechanical, or electronic, or other devices to automatically make decisions in any game, whether such use is attempted or effected by one of our customers or by a guest or by any third parties.
10. All promotions, campaigns and bonuses on this site offered for casino, poker, sportsbook and additional products have been designed for entertainment purposes only. Customers are required to participate in an appropriate level of game play in all games and products offered otherwise Winpoker.com reserves the right to blacklist players, void all winnings and to refund the original deposit amount to the players. Any winnings made using advantage-betting and/or professional methods will be considered as fraudulent and will immediately become void.
11. Collusion means a situation where two or more players attempt to earn an unfair advantage by sharing knowledge of their cards or other information at a poker table. Any player who attempts to or colludes with any other player while using the Poker Room will be prohibited from ever using the Poker Room or the Website or the Software or any of our other related services and their player account will be terminated effective immediately. Winpoker and the provider of the online poker system (iPoker network) will do our best to investigate complaints received against players suspected of collusion. If Winpoker and/or iPoker suspect collusive behaviour during a game, Winpoker and/or iPoker may, in our sole discretion, terminate the suspected players’ access to the Poker Room and/or block their accounts. Neither Winpoker nor iPoker will be liable under any circumstances whatsoever for any loss you or any other player may accrue as a result of the collusive or otherwise unlawful activity and we will not be further obliged to take any other actions in any event of suspected collusion, fraudulent behaviour or fraud.
12. All players are obliged to provide their full and accurate personal details. Failure to provide full and accurate personal details may result in disqualification, account closure or forfeit of funds. Any changes of personal details should be updated as soon as possible. All information that is sent to Winpoker will be kept in accordance with our Privacy Policy (accessible within this document, on the website and/or on request).
13. User acknowledges that full freedom from errors or incompleteness is impossible to achieve with respect to computer software. Should User become aware that the software contains such errors or incompleteness, User undertakes to refrain from taking any advantage whatsoever thereof. Moreover, promptly upon becoming aware of such error or incompleteness User shall notify the Company in writing. Should User fail to fulfill his undertakings under this Clause, the Company, or anyone appointed by the Company, shall be entitled to full compensation for all costs, including costs for rectifying the software, that may be referred to the error or incompleteness in question and User’s omission to notify the Company.
14. To maintain a high level of security in order to protect the User's funds, the Company performs random security checks. The User hereby accepts that the Company maintains the right to demand additional documentation in order to verify the User as the account holder in the event of a security check.
15. Any dispute arising out of, or relating to, the Games, prizes, web site, client application, Winpoker shall be governed by the laws of Malta.
16. The User acknowledges that all trademarks, copyrights, and other intellectual property rights in and relating to the Service are owned by us or its respective owner. No-one may create any derivative work from the Site, or any of the material which is found on the Site, unless properly licensed to do so by us. We grant you a limited license to access and use the Site, subject to the terms and conditions of the Site. However, this license does not allow you to make any commercial use or and derivative use of the Site and anything relating to the Site.
17. User is only entitled to wager and/or cash out funds which belong to him. Player acknowledges that he has no right to funds that were incorrectly deposited into his account, or obtained through abusive actions.
18. We retain the right to charge players for transactions if the costs incurred by the transfers are excessive in comparison to the rake generated.
19. If no transaction has been recorded on a customer's account for twenty-four months, Winpoker will remit the balance in that account to the customer, or if the customer cannot be satisfactorily located, to a charitable organization of our choice.
20. Winpoker is not responsible for any claims for losses or damages under any condition. All participating in the games are made at Players own risk.
21. Winpoker takes the issue of responsible gaming very seriously and has implemented guidelines for the prevention of gaming addiction. Winpoker does not accept underage gamblers. Winpoker makes every effort to avoid advertising which could attract underage individuals to play for money. It is made clear to customers that they are subject to their respective national legal requirements regarding the necessary minimum age.
At any time Winpoker customers have the possibility of:
* closing their account
* setting financial limits on deposits
* unsubscribing from newsletters etc.
* self exclude for a definite or indefinite period of time by contacting our customer service department at support@Winpoker.com.

How we collect personal information

Poker Rules
1. Poker games are played in USD, EUR and GBP.
2. Winpoker poker is powered by Tain and is connected to the iPoker Network meaning that the same player may have accounts elsewhere within the network.
3. It is strictly forbidden for a player to play at the same table with more than one account at the same time. It is also forbidden to join the same tournament with different accounts.
4. Players from the same household are not allowed to play at the same real money table or 1-table tournaments.
5. Poker is an individual game where players play for their own interest. Any kind of cooperation between players is strictly forbidden.
6. Chip dumping (when a player deliberately loses hands to transfer money to a partner player) is considered illegal and Winpoker reserves the right to freeze accounts involved in chip dumping and also to confiscate funds held in such accounts.
7. To prevent money laundering and fraud, certain rules regarding cash outs apply. In order to cash out funds that were deposited by himself (for example through credit card, Neteller, Moneybookers), Player needs to have generated poker rake equal to 20% of the deposited amount.
House rules
Winpoker like to maintain a friendly and pleasant atmosphere for all our players and visitors. Although we cannot be held responsible for any player conduct, we do reserve the right to refuse use of the poker room to anyone who violates our rules and we will act quickly against offenders. The following subjects are strictly prohibited:
* Threatening or insulting any player, visitor, or employee.
* Using obscene language or profanity.
* Racist remarks.
* Revealing any cards held or passed.
* Discussing any context of a hand in progress.
* Agreeing to check a hand down when a third player is all-in.
* Needlessly slowing down the game.
* Making any statements to induce a player to act in a certain way.
* Speaking any other language than English during a hand.
* Collusion with any other player or cheating via text.
* Bullying a player into leaving the table.
Violation of any of the above will result in either a warning, suspension of chat facilities, permanent removal of chat facilities, suspension of playing privileges, or permanent removal of playing privileges.
Promotions / Bonus T&C
All promotions are available only once per household, address, e-mail address, credit card number, bank account, and environments where computers are shared (university, fraternity, school, public library, workplace, etc).
The poker First Deposit Bonus eligibility is limited to new players who have registered a real account. Each player is allowed only one (1) Real Account.
Promotion amounts credited to a player may only be used to play in the games according to the rules set out in the bonus offer.
If a player earns more than 25 iPoints per raked dollar in poker, we reserve the right to (retroactively or otherwise) adjust any bonus or other promotional value downwards without notice.
If you already have multiple accounts you are NOT eligible for multiple bonuses in your additional accounts. Any player attempting to claim multiple bonuses for which they are not eligible will have his/her account closed and any winnings on all his/her accounts will be null and void. All cash-ins will be cancelled.
Entrants who fail to comply with any of the stipulated Terms and Conditions of a promotion will forfeit their bonus, which will subsequently be removed from their gaming account.
In the event of any dispute, the decision of the Winpoker manager will be considered full and final. No correspondence will be entered into.
Employees, officers and directors of Winpoker, its promotional or other agencies, licensees and licensors, service providers and any other associated or affiliated companies shall not be eligible for entry. The same terms shall apply to the direct families of such persons.
We reserve the right to bar any promotional abusers from receiving any promotions.
Winpoker management reserves the right to change or end a promotional offer at any time prior to the expiry date as well as changing the criteria for taking part of the promotion at any time.

Winpoker is a partner of Tain Poker, all games is played within Ipoker network.
WinPoker is licensed and regulated by the Government of Curacao, Dutch Antilles. We operate under Curacao's leading, regulated and proven Gaming Licensing & Hosting provider, Cyberluck.
WinPoker holds cash to cover all player purse balances at all times. These funds are kept in segregated accounts.
